These terms are the agreement between you and us for using DailyFrame, a photo-a-day app that turns your photos into a timelapse video. Please read them together with our Privacy Policy, which explains how the app handles data. By downloading or using the app, you agree to these terms. If you do not agree, please do not use the app.

The short version

• The app and its basic features are free. The free plan shows ads and has some limits.
• DailyFrame Pro is optional: a monthly or annual subscription, or a one-time lifetime purchase, paid through the App Store or Google Play.
• Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends. You cancel in your App Store or Google Play account. Refunds are handled by Apple or Google.
• Your photos are yours. They stay on your device unless you back them up to your own cloud account.
• You are responsible for having the right to photograph the people in your timelines, especially children.

1. Who we are

"We", "us" and "our" mean this company. "The app" means DailyFrame for iOS and Android (app id com.appatolyesi.dailyframe), including its updates.

2. Who can use the app

You must be at least 18 years old, or the age of majority where you live if that is higher, to use the app. Parents and guardians decide whether and how their children are photographed with it.

3. Your licence to use the app

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the store you downloaded it from. The app, its design, code, texts and brand remain ours or our licensors'. Open source components are used under their own licences, which are listed in the app (Settings > You and your data > About > Open source licenses).

Apps downloaded from the App Store. If you downloaded the app from Apple's App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies, in addition to these terms. If the two conflict on your use of the app, the Standard EULA prevails to the extent of the conflict. In particular:

• these terms are between you and us only, not with Apple. Apple is not responsible for the app or its content;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to meet any warranty that applies to it, you can notify Apple, and Apple will refund the price you paid for the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app;
• Apple is not responsible for handling any claims by you or anyone else about the app, including product liability claims, claims that the app does not meet a legal or regulatory requirement, consumer protection or privacy claims, and claims that the app or your use of it infringes someone else's intellectual property. We are responsible for these, as described in these terms and the law;
• you confirm that you are not located in a country that is subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

Apps downloaded from Google Play. Your use of Google Play, including purchases, is also subject to the Google Play Terms of Service.

4. Free plan and DailyFrame Pro

Free plan. The app is free to download and use. The free plan shows ads (see the Privacy Policy) and includes a limited number of timelines and a lower maximum video resolution than Pro. Your photos are never locked: viewing, sharing, saving and exporting your photos always stays free, and restoring from a backup is free, even if Pro ends.

DailyFrame Pro is optional. It removes ads and adds more room and finer options, such as unlimited timelines, 4K and HEVC video export where your device supports it, your own music as a soundtrack, export presets and templates, and cloud backup to Google Drive or Dropbox. The paywall in the app shows what Pro currently includes.

Plans. Pro is offered as:

• Monthly: an auto-renewing subscription billed every month;
• Annual: an auto-renewing subscription billed every year;
• Lifetime: a one-time purchase that does not renew and unlocks Pro for as long as the app is offered and supported.

Not every plan may be offered in every country or at every time. Prices are shown in the app and in the store before you confirm a purchase, in your local currency and including any taxes the store collects.

Payment. Payment is made through the App Store (Apple) or Google Play (Google) and is charged to your store account when you confirm the purchase. We never see your card or payment details. Apple's or Google's terms apply to the payment.

Automatic renewal. Monthly and annual subscriptions renew automatically at the end of each period, for the same length and at the then-current price, unless you cancel at least 24 hours before the current period ends. Your store account is charged for the renewal within the 24 hours before the current period ends.

How to cancel. Deleting the app or your DailyFrame account does not cancel a subscription. Cancel it in your store account:

• iPhone or iPad (App Store): open the Settings app, tap your name, then Subscriptions, choose DailyFrame and tap Cancel Subscription. You can also do this in the App Store app (your profile picture > Subscriptions).
• Android (Google Play): open the Google Play Store app, tap your profile icon, then Payments & subscriptions > Subscriptions, choose DailyFrame and tap Cancel subscription. You can also use play.google.com/store/account/subscriptions.

In the app, Settings > Photos > DailyFrame Pro > Manage subscription opens the same store page. After you cancel, Pro stays active until the end of the period you have paid for, and the subscription then does not renew.

Refunds. Because Apple or Google process the payment, refund requests are handled by them under their refund policies: for the App Store at reportaproblem.apple.com, for Google Play through the Play Store or Google Play Help. We cannot issue refunds for store purchases ourselves. This does not limit any right to withdraw from the purchase or to a refund that the consumer law of your country gives you.

Free trials and introductory prices. If a free trial or an introductory price is offered, the store shows its length, the price that follows and the date it starts before you confirm. Unless you cancel at least 24 hours before the trial or introductory period ends, the subscription continues at the regular price. If you buy a subscription during a free trial, any unused part of the trial ends when the purchase takes effect, where the store applies this.

Price changes. We may change the price of Pro plans. A change does not affect a period you have already paid for. Apple or Google tell you about a price increase for an active subscription before it applies and, where their rules or the law require it, ask for your agreement; if you do not agree, you can cancel before the new price applies.

Restoring and when Pro ends. Use Restore purchases in the app to bring back Pro on a new device signed in to the same store account. While you are signed in to a DailyFrame account, your purchases are also linked to it. If Pro ends, Pro features stop (for example, cloud backup pauses and ads return), but your timelines, photos and exports stay, and restoring and the zip export remain free.

5. Your content

You own your photos. The photos, captions, tags and timeline names you create ("your content") belong to you. We claim no ownership of them and we do not receive them: they stay on your device, unless you back them up to your own cloud account or share them yourself.

People in your photos. You are responsible for having the right, and where the law requires it the consent, to photograph the people in your timelines and to keep, share or publish those photos. This applies especially to children: only photograph a child if you are their parent or guardian or have their parent's or guardian's permission, and think about the child's privacy before you share a video.

No illegal content. Do not use the app to create, store or share content that is illegal, that sexualises or exploits children, or that infringes someone else's rights (such as privacy, image or intellectual property rights). Because your content stays on your device, we do not monitor it; you remain responsible for it.

Keep a copy. Your photos are stored on your device. They can be lost if the device is lost, stolen, damaged or reset, or if you uninstall the app. We recommend keeping a backup: your device's own backup, the app's cloud backup, or the "Export everything" zip.

6. Cloud backup through third-party providers

Cloud backup is optional. If you turn it on, the app uploads your photos and their details directly from your device to your own Google Drive or Dropbox account. Your use of those services is governed by their own terms and privacy policies, and their storage limits and fees are between you and them. We do not control those services and are not responsible for their availability, or for changes they make that affect backup. Disconnecting a provider or deleting backup files in your provider account is up to you; see the Privacy Policy, section 12.

Sign-in with Apple, Google or Facebook is likewise provided by those companies under their own terms.

7. Acceptable use

When you use the app, you agree not to:

• break the law, or use the app to harass, harm or invade the privacy of others;
• get around purchases, licence checks, ads or other technical limits, or help others to do so;
• copy, modify, distribute, sell or rent the app, or decompile or reverse engineer it, except where the law expressly allows this;
• interfere with the app, our systems or the services the app connects to, for example by overloading them, or by introducing malicious code;
• use the app in a way that breaks the rules of the App Store, Google Play, or the backup or sign-in providers.

8. Availability and changes

We work to keep the app running well and to improve it, so features may change, be added or be removed over time, and some updates may be required to keep using the app. Features that rely on others (the stores, sign-in, ads, Google Drive, Dropbox, your device's operating system) may stop working if those services change. We do not promise that the app will always be available or free of errors. If we stop offering a paid feature you have paid for, we will tell you in advance where we reasonably can, and your rights under consumer law remain.

Changes to these terms. We may update these terms, for example when the app or the law changes. We will update the "Last updated" date and, for significant changes, tell you in the app before they take effect. If you continue to use the app after a change takes effect, the new terms apply. If you do not agree, you can stop using the app and cancel any subscription.

9. Disclaimer and limitation of liability

We provide the app with reasonable care and skill. Apart from that, and from any rights that cannot be excluded by law, the app is provided "as is" and "as available", without further promises, for example that it will meet every need you have or work without interruption.

To the extent the law allows, we are not liable for:

• losses that were not reasonably foreseeable when you started using the app;
• losses caused by events outside our reasonable control, such as outages of the stores, the backup or sign-in providers, or your device;
• loss of photos or data caused by the device being lost, damaged or reset, by uninstalling the app, or by deleting content yourself, where the loss was not caused by our fault;
• business or commercial losses, since the app is for personal use.

To the extent the law allows, our total liability to you for any claim about the app is limited to the amount you paid for DailyFrame Pro in the 12 months before the event that gave rise to the claim.

What we do not exclude. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for damage caused intentionally or by gross negligence, or for anything else that cannot be excluded or limited by law. Nothing in these terms affects your statutory rights as a consumer, including your rights where the app or a paid feature is faulty or not as described.

10. Termination

You can stop using the app at any time by uninstalling it. You can delete your DailyFrame account in the app (see the account deletion page); cancel any subscription separately in your store account (section 4).

We may suspend or end your licence to use the app if you seriously or repeatedly breach these terms, or if the law requires it. Where reasonable, we will tell you first and give you a chance to fix the problem. If we end your licence without a breach on your part, your rights under consumer law to a refund for a paid period you can no longer use remain.

When the licence ends, you must stop using the app. Sections 5, 9, 11 and 12 continue to apply. Your photos on your device and in your own cloud account remain yours.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara, Türkiye have jurisdiction over disputes about these terms or the app.

This is without prejudice to the mandatory consumer protection rules of the country where you live. If you are a consumer, you keep the protection of those rules and any right they give you to bring a claim in the courts of your home country. If you are a consumer in Türkiye, you may also apply to the consumer arbitration committee (Tüketici Hakem Heyeti) or the consumer court that is competent under Consumer Protection Law No. 6502.

Before going to court, please write to us; most problems can be solved quickly by email.

12. Other terms

If a court finds part of these terms invalid, the rest stays in effect. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms to someone else; we may transfer ours to a company that takes over the app, as long as your rights are not reduced. These terms, the Privacy Policy and, for the App Store, the Standard EULA are the whole agreement between you and us about the app.

"Biz" ve "bizim" bu şirketi; "uygulama", güncellemeleri dahil iOS ve Android için DailyFrame'i (uygulama kimliği com.appatolyesi.dailyframe) ifade eder.

2. Uygulamayı kimler kullanabilir

Uygulamayı kullanmak için en az 18 yaşında veya yaşadığınız yerde reşit olma yaşı daha yüksekse o yaşta olmalısınız. Çocukların uygulamayla fotoğraflanıp fotoğraflanmayacağına ve nasıl fotoğraflanacağına ebeveynleri veya vasileri karar verir.

3. Uygulamayı kullanma lisansınız

Size, uygulamayı sahip olduğunuz veya kontrol ettiğiniz cihazlara kurup kendi ticari olmayan kullanımınız için, bu koşullara ve uygulamayı indirdiğiniz mağazanın kurallarına uygun şekilde kullanmanız için kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz. Uygulama, tasarımı, kodu, metinleri ve markası bize veya lisans verenlerimize aittir. Açık kaynak bileşenler kendi lisansları kapsamında kullanılır; bu lisanslar uygulamada listelenir (Ayarlar > Siz ve verileriniz > Hakkında > Açık kaynak lisansları).

App Store'dan indirilen uygulamalar. Uygulamayı Apple'ın App Store'undan indirdiyseniz, bu koşullara ek olarak Apple'ın Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi (Standart EULA) da geçerlidir. İkisi uygulamayı kullanımınız konusunda çelişirse, çelişki ölçüsünde Standart EULA esas alınır. Özellikle:

• bu koşullar Apple ile değil, yalnızca sizinle bizim aramızdadır. Apple uygulamadan veya içeriğinden sorumlu değildir;
• Apple'ın uygulama için bakım veya destek sağlama yükümlülüğü yoktur;
• uygulama kendisine uygulanan bir garantiyi karşılamazsa Apple'a bildirebilirsiniz; Apple uygulama için ödediğiniz bedeli (varsa) iade eder. Yasaların izin verdiği en geniş ölçüde Apple'ın uygulamayla ilgili başka bir garanti yükümlülüğü yoktur;
• ürün sorumluluğu talepleri, uygulamanın bir yasal veya düzenleyici gerekliliği karşılamadığı iddiaları, tüketici koruma veya gizlilik talepleri ve uygulamanın ya da kullanımınızın başkasının fikri mülkiyet haklarını ihlal ettiği iddiaları dahil, sizin veya başkalarının uygulamayla ilgili taleplerini ele almaktan Apple sorumlu değildir. Bu konulardan, bu koşullarda ve kanunda belirtildiği şekilde biz sorumluyuz;
• ABD hükümeti ambargosuna tabi veya ABD hükümetince "teröre destek veren" ülke olarak belirlenmiş bir ülkede bulunmadığınızı ve ABD hükümetinin yasaklı veya kısıtlı taraflar listelerinden birinde yer almadığınızı beyan edersiniz;
• Apple ve bağlı şirketleri bu koşulların üçüncü taraf lehtarıdır ve siz koşulları kabul ettiğinizde bunları size karşı uygulayabilir.

Google Play'den indirilen uygulamalar. Satın almalar dahil Google Play kullanımınız ayrıca Google Play Hizmet Şartları'na tabidir.

4. Ücretsiz plan ve DailyFrame Pro

Ücretsiz plan. Uygulamayı indirmek ve kullanmak ücretsizdir. Ücretsiz plan reklam gösterir (bkz. Gizlilik Politikası) ve sınırlı sayıda zaman çizelgesi ile Pro'ya göre daha düşük bir azami video çözünürlüğü içerir. Fotoğraflarınız asla kilitlenmez: Pro sona erse bile fotoğraflarınızı görüntüleme, paylaşma, kaydetme ve dışa aktarma her zaman ücretsiz kalır; yedekten geri yükleme de ücretsizdir.

DailyFrame Pro isteğe bağlıdır. Reklamları kaldırır ve daha fazla alan ile daha ayrıntılı seçenekler ekler: örneğin sınırsız zaman çizelgesi, cihazınızın desteklediği yerlerde 4K ve HEVC video dışa aktarma, kendi müziğinizi film müziği olarak kullanma, dışa aktarma ön ayarları ve şablonlar ve Google Drive veya Dropbox'a bulut yedekleme. Pro'nun güncel kapsamı uygulamadaki satın alma ekranında gösterilir.

Planlar. Pro şu seçeneklerle sunulur:

• Aylık: her ay ücretlendirilen, otomatik yenilenen abonelik;
• Yıllık: her yıl ücretlendirilen, otomatik yenilenen abonelik;
• Ömür boyu: yenilenmeyen, tek seferlik bir satın alma; uygulama sunulduğu ve desteklendiği sürece Pro'yu etkinleştirir.

Her plan her ülkede veya her zaman sunulmayabilir. Fiyatlar, satın almayı onaylamadan önce uygulamada ve mağazada yerel para biriminizle ve mağazanın tahsil ettiği vergiler dahil olarak gösterilir.

Ödeme. Ödeme App Store (Apple) veya Google Play (Google) üzerinden yapılır ve satın almayı onayladığınızda mağaza hesabınızdan alınır. Kart veya ödeme bilgilerinizi hiçbir zaman görmeyiz. Ödemeye Apple'ın veya Google'ın koşulları uygulanır.

Otomatik yenileme. Aylık ve yıllık abonelikler, mevcut dönemin bitmesinden en az 24 saat önce iptal etmediğiniz sürece her dönemin sonunda aynı süreyle ve o tarihteki fiyattan otomatik olarak yenilenir. Yenileme bedeli, mevcut dönemin bitişinden önceki 24 saat içinde mağaza hesabınızdan alınır.

Nasıl iptal edilir. Uygulamayı veya DailyFrame hesabınızı silmek aboneliği iptal etmez. Aboneliği mağaza hesabınızdan iptal edin:

• iPhone veya iPad (App Store): Ayarlar uygulamasını açın, adınıza, ardından Abonelikler'e dokunun, DailyFrame'i seçin ve Aboneliği İptal Et'e dokunun. Aynı işlemi App Store uygulamasında da (profil resminiz > Abonelikler) yapabilirsiniz.
• Android (Google Play): Google Play Store uygulamasını açın, profil simgenize, ardından Ödemeler ve abonelikler > Abonelikler'e dokunun, DailyFrame'i seçin ve Aboneliği iptal et'e dokunun. play.google.com/store/account/subscriptions adresini de kullanabilirsiniz.

Uygulamada Ayarlar > Fotoğraflar > DailyFrame Pro > Aboneliği yönet aynı mağaza sayfasını açar. İptal ettikten sonra Pro, ödemesini yaptığınız dönemin sonuna kadar etkin kalır ve abonelik bundan sonra yenilenmez.

İadeler. Ödemeyi Apple veya Google yürüttüğü için iade talepleri onların iade politikalarına göre onlar tarafından ele alınır: App Store için reportaproblem.apple.com, Google Play için Play Store veya Google Play Yardım. Mağaza satın almaları için iadeyi kendimiz yapamayız. Bu durum, ülkenizin tüketici mevzuatının size tanıdığı cayma veya iade haklarını sınırlamaz.

Ücretsiz denemeler ve tanıtım fiyatları. Ücretsiz deneme veya tanıtım fiyatı sunulursa, mağaza onaylamanızdan önce süresini, ardından uygulanacak fiyatı ve başlangıç tarihini gösterir. Deneme veya tanıtım döneminin bitmesinden en az 24 saat önce iptal etmezseniz abonelik normal fiyattan devam eder. Ücretsiz deneme sırasında abonelik satın alırsanız, mağazanın uyguladığı durumlarda denemenin kullanılmayan kısmı satın alma geçerli olduğunda sona erer.

Fiyat değişiklikleri. Pro planlarının fiyatını değiştirebiliriz. Değişiklik, ödemesini yaptığınız dönemi etkilemez. Etkin bir abonelikte fiyat artışı olursa Apple veya Google bunu uygulanmadan önce size bildirir ve kendi kuralları ya da kanun gerektiriyorsa onayınızı ister; kabul etmezseniz yeni fiyat uygulanmadan önce iptal edebilirsiniz.

Geri yükleme ve Pro sona erdiğinde. Aynı mağaza hesabıyla oturum açılmış yeni bir cihazda Pro'yu geri getirmek için uygulamadaki Satın alımları geri yükle seçeneğini kullanın. Bir DailyFrame hesabıyla oturum açtığınız sürece satın almalarınız bu hesaba da bağlanır. Pro sona ererse Pro özellikleri durur (örneğin bulut yedekleme duraklar ve reklamlar geri gelir), ancak zaman çizelgeleriniz, fotoğraflarınız ve dışa aktarımlarınız kalır; geri yükleme ve zip olarak dışa aktarma ücretsiz kalmaya devam eder.

5. İçeriğiniz

Fotoğraflarınız size aittir. Oluşturduğunuz fotoğraflar, açıklamalar, etiketler ve zaman çizelgesi adları ("içeriğiniz") size aittir. Bunlar üzerinde hak iddia etmeyiz ve bunları almayız: kendi bulut hesabınıza yedeklemediğiniz veya kendiniz paylaşmadığınız sürece cihazınızda kalırlar.

Fotoğraflarınızdaki kişiler. Zaman çizelgelerinizdeki kişilerin fotoğrafını çekme ve bu fotoğrafları saklama, paylaşma veya yayımlama hakkına, kanunun gerektirdiği durumlarda da rızalarına sahip olmak sizin sorumluluğunuzdadır. Bu özellikle çocuklar için geçerlidir: bir çocuğun fotoğrafını yalnızca ebeveyni veya vasisiyseniz ya da ebeveyninin veya vasisinin izni varsa çekin ve bir videoyu paylaşmadan önce çocuğun mahremiyetini düşünün.

Hukuka aykırı içerik yok. Uygulamayı hukuka aykırı, çocukları cinsel nesne hâline getiren veya istismar eden ya da başkalarının haklarını (ör. özel hayat, görüntü veya fikri mülkiyet hakları) ihlal eden içerik oluşturmak, saklamak veya paylaşmak için kullanmayın. İçeriğiniz cihazınızda kaldığı için onu izlemeyiz; içeriğinizin sorumluluğu size aittir.

Bir kopya saklayın. Fotoğraflarınız cihazınızda saklanır. Cihaz kaybolur, çalınır, hasar görür veya sıfırlanırsa ya da uygulamayı kaldırırsanız fotoğraflarınız kaybolabilir. Bir yedek tutmanızı öneririz: cihazınızın kendi yedeği, uygulamanın bulut yedeklemesi veya "Her şeyi dışa aktar" zip dosyası.

6. Üçüncü taraf sağlayıcılarla bulut yedekleme

Bulut yedekleme isteğe bağlıdır. Açarsanız uygulama fotoğraflarınızı ve ayrıntılarını doğrudan cihazınızdan kendi Google Drive veya Dropbox hesabınıza yükler. Bu hizmetleri kullanımınız onların kendi koşullarına ve gizlilik politikalarına tabidir; depolama sınırları ve ücretleri sizinle onlar arasındadır. Bu hizmetleri kontrol etmeyiz; erişilebilirliklerinden veya yedeklemeyi etkileyen değişikliklerinden sorumlu değiliz. Bir sağlayıcının bağlantısını kesmek veya sağlayıcı hesabınızdaki yedek dosyalarını silmek size bağlıdır; bkz. Gizlilik Politikası, bölüm 12.

Apple, Google veya Facebook ile oturum açma da aynı şekilde bu şirketler tarafından kendi koşulları kapsamında sağlanır.

7. Kabul edilebilir kullanım

Uygulamayı kullanırken şunları yapmamayı kabul edersiniz:

• kanunu ihlal etmek veya uygulamayı başkalarını taciz etmek, onlara zarar vermek ya da özel hayatlarına müdahale etmek için kullanmak;
• satın almaları, lisans kontrollerini, reklamları veya diğer teknik sınırları aşmak ya da başkalarının bunu yapmasına yardım etmek;
• kanunun açıkça izin verdiği durumlar dışında uygulamayı kopyalamak, değiştirmek, dağıtmak, satmak veya kiralamak ya da kaynak koda dönüştürmek veya tersine mühendislik yapmak;
• uygulamaya, sistemlerimize veya uygulamanın bağlandığı hizmetlere, örneğin aşırı yükleyerek veya kötü amaçlı kod ekleyerek müdahale etmek;
• uygulamayı App Store, Google Play veya yedekleme ya da oturum açma sağlayıcılarının kurallarını ihlal edecek şekilde kullanmak.

8. Erişilebilirlik ve değişiklikler

Uygulamanın iyi çalışması ve gelişmesi için çalışırız; bu nedenle özellikler zamanla değişebilir, eklenebilir veya kaldırılabilir ve uygulamayı kullanmaya devam etmek için bazı güncellemeler gerekebilir. Başkalarına dayanan özellikler (mağazalar, oturum açma, reklamlar, Google Drive, Dropbox, cihazınızın işletim sistemi) bu hizmetler değişirse çalışmayı bırakabilir. Uygulamanın her zaman erişilebilir veya hatasız olacağını taahhüt etmeyiz. Ödemesini yaptığınız ücretli bir özelliği sunmayı bırakırsak, makul olarak mümkün olduğunda bunu önceden bildiririz; tüketici mevzuatından doğan haklarınız saklıdır.

Bu koşullardaki değişiklikler. Bu koşulları, örneğin uygulama veya mevzuat değiştiğinde güncelleyebiliriz. "Son güncelleme" tarihini güncelleriz ve önemli değişiklikleri yürürlüğe girmeden önce uygulama içinde bildiririz. Bir değişiklik yürürlüğe girdikten sonra uygulamayı kullanmaya devam ederseniz yeni koşullar geçerli olur. Kabul etmiyorsanız uygulamayı kullanmayı bırakabilir ve aboneliğinizi iptal edebilirsiniz.

9. Sorumluluk reddi ve sorumluluğun sınırlandırılması

Uygulamayı makul özen ve beceriyle sunarız. Bunun dışında ve kanunen hariç tutulamayan haklar saklı kalmak kaydıyla uygulama, örneğin her ihtiyacınızı karşılayacağı veya kesintisiz çalışacağı gibi ek taahhütler olmaksızın "olduğu gibi" ve "erişilebildiği ölçüde" sunulur.

Kanunun izin verdiği ölçüde şunlardan sorumlu değiliz:

• uygulamayı kullanmaya başladığınızda makul olarak öngörülemeyen zararlar;
• mağazaların, yedekleme veya oturum açma sağlayıcılarının ya da cihazınızın kesintileri gibi makul kontrolümüz dışındaki olayların yol açtığı zararlar;
• kayıp bizim kusurumuzdan kaynaklanmadığı sürece, cihazın kaybolması, hasar görmesi veya sıfırlanması, uygulamanın kaldırılması ya da içeriği kendinizin silmesi nedeniyle fotoğraf veya veri kaybı;
• uygulama kişisel kullanım için olduğundan iş veya ticari kayıplar.

Kanunun izin verdiği ölçüde, uygulamayla ilgili herhangi bir talep için size karşı toplam sorumluluğumuz, talebe yol açan olaydan önceki 12 ay içinde DailyFrame Pro için ödediğiniz tutarla sınırlıdır.

Hariç tutmadıklarımız. Bu koşullardaki hiçbir hüküm; ihmalimizden kaynaklanan ölüm veya bedensel zarar, hile, kasıt veya ağır ihmalle verilen zarar ya da kanunen hariç tutulamayan veya sınırlandırılamayan başka herhangi bir konudaki sorumluluğumuzu hariç tutmaz veya sınırlamaz. Bu koşullar, uygulamanın veya ücretli bir özelliğin ayıplı ya da tanıtıldığı gibi olmaması durumundaki haklarınız dahil, tüketici olarak kanuni haklarınızı etkilemez.

10. Sona erme

Uygulamayı kaldırarak istediğiniz zaman kullanmayı bırakabilirsiniz. DailyFrame hesabınızı uygulama içinden silebilirsiniz (bkz. hesap silme sayfası); aboneliğinizi ise mağaza hesabınızdan ayrıca iptal edin (bölüm 4).

Bu koşulları ciddi şekilde veya tekrar tekrar ihlal etmeniz ya da kanunun gerektirmesi hâlinde uygulamayı kullanma lisansınızı askıya alabilir veya sona erdirebiliriz. Makul olduğunda önce size bildirir ve sorunu düzeltmeniz için fırsat tanırız. Lisansınızı sizden kaynaklanmayan bir nedenle sona erdirirsek, artık kullanamayacağınız ücretli dönem için tüketici mevzuatından doğan iade haklarınız saklıdır.

Lisans sona erdiğinde uygulamayı kullanmayı bırakmanız gerekir. Bölüm 5, 9, 11 ve 12 geçerliliğini korur. Cihazınızdaki ve kendi bulut hesabınızdaki fotoğraflarınız size ait olmaya devam eder.

11. Uygulanacak hukuk ve uyuşmazlıklar

Bu koşullar Türkiye Cumhuriyeti kanunlarına tabidir. Bu koşullar veya uygulamayla ilgili uyuşmazlıklarda Ankara (Türkiye) mahkemeleri ve icra daireleri yetkilidir.

Bu hüküm, yaşadığınız ülkenin emredici tüketici koruma kurallarına halel getirmez. Tüketiciyseniz bu kuralların korumasından ve size tanıdıkları, kendi ülkenizin mahkemelerinde dava açma hakkından yararlanmaya devam edersiniz. Türkiye'de tüketiciyseniz 6502 sayılı Tüketicinin Korunması Hakkında Kanun uyarınca yetkili tüketici hakem heyetine veya tüketici mahkemesine de başvurabilirsiniz.

Yargı yoluna gitmeden önce lütfen bize yazın; çoğu sorun e-postayla hızla çözülebilir.

12. Diğer hükümler

Bir mahkeme bu koşulların bir bölümünü geçersiz bulursa geri kalanı yürürlükte kalır. Bir hakkımızı hemen kullanmamamız, onu daha sonra kullanmamıza engel değildir. Bu koşullardan doğan haklarınızı başkasına devredemezsiniz; biz ise haklarınız azalmamak kaydıyla kendi haklarımızı uygulamayı devralan bir şirkete devredebiliriz. Bu koşullar, Gizlilik Politikası ve App Store için Standart EULA, uygulama konusunda sizinle aramızdaki sözleşmenin tamamıdır.
